These Terms and Conditions govern the relationship between Cresthollow ("we", "us", "our") and any individual or household ("you", "User") who engages our editorial and archival services. By submitting an enquiry, entering into a service arrangement, or requesting any deliverable from Cresthollow, you acknowledge that you have read and understood these terms.
Cresthollow provides editorial, archival, and documentation support services only. Nothing in these terms, nor in any deliverable produced by Cresthollow, constitutes legal, financial, medical, or professional regulated advice of any kind.
1. Definitions
- "Service"
- refers to any editorial, archival, documentary, or printed deliverable offered by Cresthollow, including the Herbarium of Family Recipes, the Family Garden Memory Plate, and the Estate Reference Compendium.
- "User" or "Client"
- refers to any person or household that submits a request, makes payment, or otherwise engages Cresthollow for a service.
- "We", "Us", "Our"
- refers to Cresthollow, operating at 9 Jalan Ipoh, 51200 Kuala Lumpur, Malaysia.
- "Content"
- refers to materials, texts, photographs, recordings, documents, and any other matter supplied by the User for incorporation into a deliverable.
- "Agreement"
- refers to the arrangement formed between Cresthollow and the User upon confirmation of a service engagement, governed by these Terms and Conditions together with any written scope agreement.
- "Deliverable"
- refers to the printed or digital output produced by Cresthollow under a confirmed service arrangement.
2. Acceptance of Terms
Engagement with Cresthollow's services — whether through our website, by telephone, or in writing — constitutes acceptance of these Terms and Conditions in full. If you do not agree with any part of these terms, you should not proceed with an engagement.
You confirm that you are at least 18 years of age and have the legal capacity to enter into a service agreement. Where a service is arranged on behalf of a household or estate, the person arranging the service confirms they have authority to act on behalf of that household.
These terms apply equally to all forms of engagement, including initial enquiries, confirmations, and the delivery of any completed work.
3. Service Description
Cresthollow offers editorial and archival documentation services to households in Malaysia. Our three principal services are:
- Herbarium of Family Recipes (RM 1,180) — A printed volume gathering up to twenty family recipes supplied by the household, presented in a herbarium-style layout with short editorial notes. Two printed copies and a digital file are delivered.
- Family Garden Memory Plate (RM 320) — A single-visit engagement to record the planting history of a family garden, resulting in one printed plate suitable for filing with family papers.
- Estate Reference Compendium (RM 4,140) — A reference volume of approximately sixty pages compiled over five months from household heritage materials, delivered in two printed copies.
All services are editorial and archival in nature. Cresthollow does not provide legal, financial, medical, or regulated professional advice through any of its services or deliverables.
Services are offered to clients based in Malaysia. Arrangements for clients outside Malaysia may be considered upon enquiry and at Cresthollow's discretion.
4. User Responsibilities
When engaging Cresthollow, you agree to:
- —Supply materials (recipes, photographs, documents, notes) that you own or have permission to share for archival purposes.
- —Provide accurate and complete information when requested to ensure the deliverable reflects your household's material faithfully.
- —Respond to requests for clarification or additional material within a reasonable timeframe to avoid delays to the agreed schedule.
- —Not use any deliverable produced by Cresthollow for commercial resale, redistribution, or any purpose that misrepresents its archival nature.
- —Not submit materials that infringe on the intellectual property rights of any third party, or that contain content that would be unlawful to reproduce.
- —Keep any access credentials or draft review links shared by Cresthollow confidential.
Cresthollow records materials as supplied. We do not verify the factual accuracy of household histories, recipe attributions, or family records, and we accept no responsibility for the accuracy of content as provided by the User.
5. Intellectual Property
All design elements, typographic layouts, editorial structures, plate formats, and visual compositions developed by Cresthollow remain the intellectual property of Cresthollow. These are provided to you under a limited, non-exclusive, non-transferable licence for personal household use only.
The content you supply — recipes, photographs, family records, notes, and conversation recordings — remains your property. By supplying this content to Cresthollow, you grant us a limited licence to process, typeset, and present that content solely for the purpose of producing your agreed deliverable.
You may not reproduce, adapt, or distribute the design format of any Cresthollow deliverable without written permission. Use of our brand name, logo, or visual identity in any form requires prior written consent.
Cresthollow retains the right to retain anonymised records of completed work for internal quality and reference purposes. No personally identifiable household content is retained beyond what is necessary for the completion of your service.
6. Payment Terms
All fees are quoted and payable in Malaysian Ringgit (RM). The applicable service fees at time of publication are:

- — Estate Reference Compendium: RM 4,140
A deposit of 50% of the agreed service fee is required to confirm the engagement and begin work. The remaining balance is due upon delivery of the completed deliverable. Payment details will be provided in writing at time of confirmation.
Cresthollow accepts payment by bank transfer. Other methods may be agreed upon in writing at our discretion.
Refund Policy: Where work has not yet commenced, deposits are refundable in full upon written notice of cancellation. Where work has commenced, the deposit is non-refundable, as it covers time, visits, and editorial preparation already undertaken. Completed deliverables are non-refundable. If a deliverable contains a material error on Cresthollow's part, we will arrange a corrected edition at no additional charge.
Cresthollow reserves the right to revise service fees for future engagements. Any revision will not affect confirmed arrangements already in progress.
7. Service-Specific Terms
Delivery and Scope
Each service is scoped at the time of confirmation. Changes to scope requested after commencement of work may affect delivery timelines and fees; any such changes will be discussed and agreed in writing before proceeding.
Timelines
Indicative timelines are provided at the time of engagement. Timelines are subject to the timely supply of materials by the User. Cresthollow will communicate any delays in good time and will make reasonable efforts to complete work within agreed periods. The Estate Reference Compendium is produced across approximately five months; this is an indicative period and not a firm guarantee.
Confidentiality
Cresthollow treats all household materials shared during an engagement as confidential. We do not share, publish, or distribute your content to any third party except where required by Malaysian law. Printed proofs and digital drafts shared for review should be treated as confidential by the User.
Deliverable Format
Printed deliverables are produced to the standard format for each service. Minor variations in paper stock, print finish, or binding may occur depending on supplier availability; we will communicate any material changes before production.
8. Disclaimers
Cresthollow's services are provided as editorial and archival support. All deliverables are informational and reflective in nature. Nothing produced by Cresthollow constitutes professional advice — legal, financial, medical, genealogical, or otherwise.
Cresthollow does not verify the historical accuracy, legal standing, or factual completeness of content supplied by clients. Records, recipes, and family histories are presented as provided.
While we take care to produce deliverables of consistent quality, we cannot guarantee that a printed or digital volume will suit every specific purpose the User may have in mind beyond the scope described at engagement.
Website content, service descriptions, and pricing information are provided for informational purposes and may be updated periodically. Current terms apply as published at time of engagement.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Cresthollow's total liability to any User in connection with a service shall not exceed the total fees paid by that User for the specific service giving rise to the claim.
Cresthollow shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of data, loss of materials supplied by the User, or loss of anticipated archival purpose, except where such loss arises directly from Cresthollow's proven negligence.
In the event of loss or damage to original materials supplied for scanning or photography, Cresthollow's liability is limited to the replacement cost of the physical medium, not the sentimental or historical value of the content.
Force majeure events — including natural events, utility failures, supplier disruptions, or unforeseen circumstances beyond reasonable control — excuse Cresthollow from timely performance without liability, provided we communicate any such delay promptly.
10. Indemnification
You agree to hold Cresthollow, its staff, and its representatives harmless from any claim, loss, or expense arising from:
- —Content you supplied that infringes the rights of a third party.
- —Inaccurate, incomplete, or misleading information provided during the engagement.
- —Use of a completed deliverable in a manner not contemplated by the agreed service scope.
- —Any breach of these Terms and Conditions on your part.
11. Termination
Either party may withdraw from a service engagement by written notice. The consequences depend on the stage of work:
- —Before commencement: all fees paid are refunded in full to the User.
- —After commencement but before delivery: the deposit is retained by Cresthollow to cover work already undertaken. Any additional amounts paid may be considered for partial return at Cresthollow's discretion depending on progress.
- —After delivery: no refund is applicable.
Cresthollow reserves the right to withdraw from an engagement where the User's supplied content is found to be unlawful, third-party-infringing, or otherwise contrary to these terms. In such cases, a fair portion of fees may be retained to cover work already completed.
Provisions concerning intellectual property, confidentiality, limitation of liability, and dispute resolution survive the termination of any engagement.
12. Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with a Cresthollow service shall first be addressed through direct correspondence between the parties, with a good-faith effort to reach a resolution within 30 days of the dispute being raised in writing.
If informal resolution is not achieved within that period, the parties may agree to refer the matter to mediation through the Malaysian Mediation Centre or a mutually agreed mediator before initiating any formal proceedings.
Where proceedings cannot be avoided, the courts of Kuala Lumpur, Malaysia shall have exclusive jurisdiction. The Consumer Protection Act 1999 (Malaysia) and other applicable Malaysian consumer protection legislation apply to consumer engagements as provided by law.
13. General Provisions
Entire Agreement. These Terms and Conditions, together with any written scope confirmation provided at the time of engagement, constitute the entire agreement between the parties regarding the subject matter and supersede all prior communications.
Severability. If any provision of these terms is found to be unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions continue in full force.
Waiver. Cresthollow's failure to enforce any right or provision of these terms on a particular occasion does not constitute a waiver of that right or provision going forward.
Assignment. You may not assign your rights or obligations under a service agreement without Cresthollow's prior written consent. Cresthollow may engage sub-contractors or collaborators to assist in producing deliverables while retaining overall responsibility for quality.
Notices. Formal notices under these terms should be sent in writing to the address or email address provided in Section 15. Notices sent by email are considered received on the next business day after sending, provided no delivery failure notification is received.
14. Changes to Terms
Cresthollow may revise these Terms and Conditions from time to time. When revisions are made, the updated document will be published on this page with a new Last Updated date. We will make reasonable efforts to communicate material changes to clients with active engagements.
Continuing to engage with Cresthollow's services after a revision has been published constitutes acceptance of the updated terms. Terms in effect at the time of a confirmed engagement remain applicable to that engagement unless both parties agree otherwise in writing.
